We are a licensed mortgage broker operating in Arizona, California, Colorado, Idaho, Florida, Montana, Ohio, Oregon, and Texas. This Policy is designed to comply with applicable federal and state privacy laws, including the Gramm-Leach-Bliley Act (GLBA), the California Consumer Privacy Act (CCPA/CPRA), the California Online Privacy Protection Act (CalOPPA), and applicable regulations under the Equal Credit Opportunity Act (ECOA) and Fair Housing Act (FHA).

We collect personal information through our website when you voluntarily submit it via contact forms, loan inquiry forms, or other interactive features. We do not collect personal information from visitors who browse our site without submitting a form.

Important: We do not engage in automated decision-making or profiling with respect to mortgage eligibility based solely on data collected from this website. Loan decisions involve human review and are subject to standard underwriting criteria. 

3. Telephone and Text Message Communications (TCPA)

By submitting a contact or inquiry form on our website and providing your phone number, you expressly consent to receive telephone calls and/or text messages from Lender Express Mortgage LLC and its licensed loan officers, including calls or texts made using an automatic telephone dialing system (ATDS) or an artificial or prerecorded voice, as permitted by the Telephone Consumer Protection Act (TCPA). 

 

Consent to receive calls or texts is not a condition of obtaining a mortgage or any other product or service from us. Message and data rates may apply. You may opt out of text messages at any time by replying STOP. To opt out of telephone calls, contact us at the information provided in Section 11. 

4. Email Marketing (CAN-SPAM)

If you subscribe to our email list or opt in to receive company communications, we will send you periodic emails related to mortgage products, interest rate updates, or company news. Each marketing email will include:

A. Wholesale Lenders and Mortgage Partners

 

When you submit a loan inquiry and choose to proceed with an application, we may share your information with wholesale lenders, investors, or other mortgage industry participants as necessary to process your application. This sharing is inherent to the mortgage brokerage model and is disclosed in the required Loan Estimate and Closing Disclosure documents.

 

B. Service Providers

 

We may engage third-party vendors (including CRM platforms, loan origination software providers, and website hosting services) who process data on our behalf under contractual data processing agreements. These providers are prohibited from using your data for any purpose other than providing services to us.

 

C. Legal Compliance and Safety

 

We may disclose your information when required to do so by law, regulation, court order, or government request, or when we believe in good faith that disclosure is necessary to protect our rights, prevent fraud, or respond to a safety emergency. 

 

D. Business Transfers

 

In the event of a merger, acquisition, or sale of all or substantially all of our assets, your information may be transferred to the successor entity, subject to the same privacy commitments described in this Policy.

Note: California’s GLBA exemption applies to personal information collected for the purpose of providing financial services. Much of the information collected in connection with mortgage applications is governed by the GLBA privacy notice we provide separately, rather than by CCPA.

8. Children’s Privacy (COPPA)

Our website is intended for adults and is not directed to children under 13 years of age. We do not knowingly collect personal information from children under 13. If we become aware that we have inadvertently collected information from a child under 13, we will promptly delete it. If you believe a child has submitted information to us, please contact us immediately.
